These terms govern your use of PassPhoto and the services we provide. Please read them carefully before placing an order.

Definitions

In these Terms and Conditions, the following terms have the meanings set out below. Understanding these definitions will help clarify the rights and obligations of both parties throughout the document.

"PassPhoto"
PassPhoto Australia, the operator of passphoto.com.au and all associated services. References to "we", "us", or "our" throughout these terms refer to PassPhoto.
"Customer"
Any individual or entity that accesses our website, places an order, or uses any part of our service. References to "you" or "your" refer to the Customer.
"Service"
The passport and visa photo processing, expert compliance review, digital delivery, and physical print production and delivery services offered by PassPhoto.
"Order"
A completed purchase transaction placed through our website, including the selection of a product tier, submission of a photo, and successful payment.
"Compliance Review"
The manual expert assessment performed by a PassPhoto specialist that checks your submitted photo against the official specifications of the relevant issuing authority.
"Issuing Authority"
The government body, consulate, embassy, or official agency responsible for accepting and processing passport or visa applications (e.g. Australian Department of Home Affairs, VFS Global).
"Uploaded Photo"
The photograph submitted by the Customer via our upload interface for processing under a placed Order.
"Website"
The PassPhoto website located at passphoto.com.au and all pages, subdomains, and resources associated with it.

Our Service

PassPhoto provides a certified passport and visa photo service for Australians. We accept a photo uploaded by you, perform a manual compliance review against official government specifications, and deliver the result either digitally, as physical prints to your door, or both - depending on the product you select.

Our service covers passport and visa photo requirements for 60+ countries, including Australia, China, India, the Philippines, Vietnam, the United Kingdom, South Korea, Lebanon, the United States, New Zealand, Hong Kong, and others listed on our website.

What our Compliance Review includes

Every submitted photo is checked by a trained human specialist - not automated software alone - against 12 key criteria including: background colour and uniformity, head size and positioning, face proportion ratios, shadow presence, expression, eye visibility, image recency, resolution and print quality requirements.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice where this affects existing orders.

Use of the Service is restricted to persons aged 18 or over, or minors acting under direct parental or guardian supervision and authorisation. By placing an Order, you confirm you meet this requirement.

The Service is designed for use by Australian residents and persons applying for travel documents through Australian authorities or consulates based in Australia.
We do not guarantee that photo specifications we hold are current at every moment. While we maintain specifications with regular updates, government requirements occasionally change without public notice.
PassPhoto is an independent private service provider. We have no affiliation with any government department, embassy, consulate, or official issuing authority.

Orders & Payment

An Order is placed when you complete checkout on our website and receive a confirmation email with your order number. By completing checkout, you confirm that you have read and agree to these Terms and Conditions in their entirety.

All payments are processed securely through Shopify Payments or other payment providers we make available at checkout. We accept major credit and debit cards. Your payment details are never stored by PassPhoto - they are handled exclusively by our payment processor.

Prices are listed in Australian Dollars (AUD) inclusive of GST where applicable. A tax invoice will be provided with your order confirmation upon request.

Order confirmation - You will receive an email confirmation at the address provided at checkout. This constitutes your receipt and order reference.
Photo submission - In order page, You will be prompted to upload your photo. Processing begins once a valid photo is received. Uploading constitutes your consent for us to process the image under these Terms.
Re-upload requests - If your submitted photo does not meet minimum requirements (e.g. extreme blur, wrong person, fully unlit), we will contact you by email to request a replacement. Processing timelines begin from receipt of the acceptable photo.
Order cancellation - You may cancel your order for a full refund before your photo has been reviewed. Once the compliance review has commenced, we are unable to cancel the order as the service has been partially performed.

Our current pricing tiers are listed below. All prices are in AUD and include GST. Prices are subject to change with reasonable notice posted on our website. Orders are charged at the price displayed at the time of checkout.

Delivery charges, where applicable, are displayed at checkout and included in the above pricing. We reserve the right to introduce promotional pricing, which will be clearly marked as such and subject to any specific terms attached to the promotion.

100% Acceptance Guarantee

PassPhoto offers a 100% Acceptance Guarantee on all orders. If your photo is rejected by the relevant Issuing Authority specifically and solely due to a compliance issue with the photo itself, we will redo the photo and redeliver it at no additional cost to you.

How to claim the guarantee

Contact us at support@passphoto.com.au with your order number and the official rejection notice or written confirmation from the Issuing Authority. We will assess your claim and, if valid, arrange a replacement at no charge.

The guarantee applies only to rejections based on objective photo compliance matters - such as incorrect dimensions, improper background, or non-compliant head sizing - where the fault lies with our processing or our compliance assessment, not with factors outside our control.

Guarantee exclusions

The guarantee does not apply where: (a) the rejection is due to information or factors unrelated to the photo itself (e.g. incorrect application forms, expired documents, identity discrepancies); (b) the Customer provided deliberately misleading or materially inaccurate information when placing the order; (c) the photo was physically altered, damaged, or marked by the Customer after delivery; (d) the Issuing Authority changed its requirements after we processed your order; or (e) the Customer selected the wrong country or document type at checkout.

Claims must be submitted within 5 days of the original order date. Claims submitted after this period may be declined at our discretion.
The guarantee applies to a single remedy per Order - either a replacement photo or a full refund of the original order value. We do not pay compensation beyond this.
For Digital Only orders, the guarantee remedy is a replacement digital file or a refund. No physical reprints will be provided unless you upgrade to a print-included tier.

Refunds & Returns

We aim to ensure every customer is satisfied with their order. Our refund policy is governed by Australian Consumer Law (ACL) and any specific terms outlined here.

Pre-review cancellation - If you cancel your order before we have commenced the compliance review, you are entitled to a full refund. Contact us as soon as possible after placing your order if you wish to cancel.
Post-review refunds - Once the compliance review has been completed, the service has been substantially performed. Refunds at this stage are only available in accordance with the Acceptance Guarantee (Section 5) or if a major fault occurred on our part.
Printed photos - Due to the personalised nature of printed passport photos, we do not accept returns of printed photos unless they are materially defective (e.g. printing error, wrong size produced by us) or the wrong product was delivered.
Australian Consumer Law - Nothing in these Terms limits or excludes any guarantee, condition, warranty, or consumer right under the Australian Consumer Law that cannot legally be excluded or limited.
Processing time - Approved refunds are processed within 5–7 business days to the original payment method. We are not responsible for delays caused by your bank or card issuer.

Delivery

PassPhoto delivers physical prints Australia-wide via tracked postal services. Digital files are delivered by email and/or via a download link to the address provided at checkout.

Estimated timeframes - We aim to dispatch physical prints within 1–2 business days of a successful compliance review. Delivery to most Australian metropolitan areas takes a further 1–3 business days. Regional and remote areas may take longer.
Digital delivery - Digital files are sent by email within the stated processing timeframe after the compliance review is complete. Please check your spam folder if you do not receive the file within the expected window.
Delivery address - You are responsible for providing a correct and complete delivery address at checkout. PassPhoto is not liable for delays or non-delivery resulting from an incorrect address provided by the Customer.
Lost or damaged post - If your prints are lost or damaged in transit, contact us with your order number and we will arrange a replacement dispatch at no additional charge, subject to reasonable verification.
Force majeure - We are not liable for delivery delays caused by circumstances beyond our control, including postal service disruptions, natural disasters, or public health emergencies.

Your Photo & Our Obligations

By uploading a photograph to PassPhoto, you represent and warrant that you are the subject of the photograph, or that you have explicit consent from the subject (and their parent or guardian if a minor) to submit the photograph for processing under these Terms.

Licence to process - You grant PassPhoto a limited, non-exclusive licence to store, process, resize, crop, and otherwise handle your uploaded photograph solely for the purpose of fulfilling your Order.
Data retention - Your uploaded photograph and processed files are retained for a maximum of 30 days from the date of your Order, after which they are permanently deleted from our systems.
No commercial use - We will never use your photograph for marketing, advertising, training datasets, third-party sharing, or any purpose other than processing your Order.
Prohibited submissions - You must not upload photographs of another person without their consent, stock photographs, digitally manipulated or AI-generated faces, or images that violate any applicable law. Such submissions will be rejected and your order may be cancelled without refund.
Photo quality - We require a minimum resolution of 600×780 pixels for acceptable processing. Extremely low-resolution, blurred, or dark photos may delay your order while we request a re-upload.

Privacy & Data

PassPhoto takes privacy seriously. We collect only the information necessary to fulfil your Order and operate our service. This section summarises our key data practices - our full Privacy Policy contains complete details and governs any conflict with this summary.

Data we collect - Name, email address, delivery address, payment information (processed by our payment provider, not stored by us), and the photograph you upload.
How we use it - Order fulfilment, delivery, compliance review, customer support, and legal compliance. We do not sell, rent, or share your personal data with third parties for marketing purposes.
Australian Privacy Principles - We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Your photo constitutes biometric information and is treated with the highest level of care and confidentiality.
Data deletion - Your photo is permanently deleted within 30 days of your order. Your name, email, and address are retained for up to 7 years for legal, tax, and accounting purposes, then permanently deleted.
Your rights - You have the right to access, correct, or request deletion of your personal data. Submit requests to support@passphoto.com.au. We will respond within 30 days.

Intellectual Property

All content on the PassPhoto website - including text, design, graphics, logos, icons, page layouts, compliance guides, country specification content, and software - is the intellectual property of PassPhoto Australia or its licensors and is protected by Australian and international copyright law.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this website without prior written permission from PassPhoto, except where permitted by applicable law for personal, non-commercial use.

The PassPhoto name, logo, and brand elements are trademarks of PassPhoto Australia. Use of these marks without authorisation is strictly prohibited.

Ownership of your processed photo

You retain full ownership of the original photograph you upload. The processed, cropped, and compliance-adjusted version delivered to you is also yours to use for any lawful personal purpose, including submitting it to any Issuing Authority. PassPhoto retains no rights in the delivered photo beyond the limited processing licence described in Section 8.

Limitation of Liability

To the maximum extent permitted by Australian law, PassPhoto's total liability to you arising out of or in connection with any Order or use of the Service will not exceed the amount paid by you for the relevant Order.

We are not liable for any indirect, consequential, incidental, or special loss or damage, including but not limited to: missed travel deadlines, visa or passport application delays, costs of alternative travel arrangements, or any loss arising from relying on country specification information that has changed after we last updated it.

Important limitation

PassPhoto does not guarantee that your passport or visa application will be approved. Our service guarantees the photo will meet the published photographic specifications of the relevant Issuing Authority. Application outcomes depend on many factors entirely beyond our control and responsibility.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited under Australian Consumer Law.

Our website and service are provided "as is" without warranties of any kind beyond those required by law. We do not warrant that the website will be continuously available, error-free, or free from viruses or other harmful components.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our service, pricing, legal requirements, or operational practices. When we do, we will update the "Last updated" date at the top of this page and, for material changes, post a notice on our website.

Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and contact us if you have an active order.

We recommend reviewing these Terms periodically. The version of these Terms in effect at the time you place an Order governs that Order. Changes will not apply retroactively to orders already placed before the effective date of the revised Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.
